1. About PH Mechanic

PH Mechanic is an independent online automotive directory and marketplace available through phmechanic.com and related PH Mechanic services.

PH Mechanic is a product line operated under JDWebcraft Web Development Services, a sole proprietorship registered in the Philippines and based in Davao City, Philippines.

For purposes of these Terms, "PH Mechanic," "we," "our," and "us" refer to the operator of the PH Mechanic platform.

PH Mechanic enables users to discover automotive businesses, mechanics, towing providers, roadside assistance providers, motorcycle service providers, parts sellers, and other automotive-related businesses. The Platform may also provide functionality for shop listings, product listings, bookings, inquiries, reviews, order tracking, subscriptions, and other related services.

2. Acceptance of These Terms

By accessing, creating an account on, submitting information to, purchasing through, booking through, listing a business on, or otherwise using PH Mechanic, you agree to these Terms and all other policies incorporated into them.

If you do not agree, you must stop using PH Mechanic.

You must be at least 18 years old to create an account, operate a vendor account, place orders, submit bookings, or otherwise enter into transactions through the Platform.

PH Mechanic is primarily intended for users and businesses located in the Philippines.

3. PH Mechanic's Role

PH Mechanic acts primarily as an independent directory and marketplace platform connecting users with third-party automotive businesses and vendors.

Unless expressly stated otherwise, PH Mechanic:

• does not employ the vendors listed on the Platform;
• does not perform automotive repairs or maintenance;
• does not provide towing or roadside assistance itself;
• does not manufacture products listed by vendors;
• does not act as a courier;
• does not receive customer payments for vendor products;
• does not control the day-to-day operations of vendors; and
• is not automatically a party to agreements entered into directly between a customer and vendor.

Vendors are independent third parties responsible for their products, services, representations, pricing, workmanship, warranties, delivery obligations, permits, qualifications, and customer commitments.

Nothing in these Terms excludes or limits responsibilities that PH Mechanic may have under applicable Philippine law.

4. Accounts

Users must provide accurate and current information when creating or maintaining an account.

You are responsible for:

• maintaining the confidentiality of your account;
• protecting access to your email and authentication credentials;
• ensuring information associated with your account remains accurate; and
• notifying PH Mechanic if you suspect unauthorized use.

You may not impersonate another person or business, create fraudulent accounts, use another person's identity without authorization, or circumvent account restrictions.

PH Mechanic may require additional verification where necessary for security, fraud prevention, legal compliance, vendor verification, or marketplace integrity.

5. Vendor and Shop Listings

Vendor listings may include information such as:

• business name;
• address and map location;
• telephone number;
• operating hours;
• services;
• pricing information;
• vehicle compatibility;
• photographs;
• logos;
• products;
• customer reviews; and
• other information relating to the business.

Vendors are responsible for keeping their listing information accurate and updated.

PH Mechanic may correct formatting, remove inappropriate content, investigate inaccurate information, or restrict a listing where reasonably necessary.

Additional requirements applicable to vendors are contained in the Vendor, Listing & Verification Policy.

6. Unclaimed Listings

PH Mechanic may create listings using business information that is already publicly available, including information published by businesses on publicly accessible social media pages and similar public business sources.

An unclaimed listing does not mean that:

• the business created the listing;
• the business has registered with PH Mechanic;
• the business endorses PH Mechanic; or
• PH Mechanic endorses the business.

Business owners may request to claim, correct, or remove eligible unclaimed listings.

A successful claim may require identity or business verification.

7. Vendor Verification

PH Mechanic may verify vendors before allowing them to use certain features.

Verification generally confirms that specified identity or business information has been submitted and reviewed. Verification does not constitute an inspection, certification, warranty, or guarantee regarding:

• workmanship;
• service quality;
• product quality;
• safety;
• professional competence;
• financial condition; or
• future conduct of the vendor.

A PH Mechanic verification status must not be represented as a government accreditation.

Premium subscription status and vendor verification are separate concepts.

8. Products and Marketplace Transactions

Vendors may offer automotive-related products through PH Mechanic.

Unless otherwise expressly stated, the product transaction is between the buyer and the vendor.

The vendor is responsible for:

• product descriptions;
• prices;
• stock availability;
• product condition;
• authenticity;
• warranties;
• legal compliance;
• fulfillment;
• shipping;
• returns; and
• refunds.

Vendors must accurately describe products and must not engage in deceptive, unfair, or misleading practices.

Philippine law provides remedies for qualifying defective, malfunctioning, lost, misdescribed, or non-conforming online purchases, including potential repair, replacement, or refund remedies.

9. Payments Between Buyers and Vendors

PH Mechanic does not currently process or receive the purchase price of products sold by third-party vendors.

Product payments may be completed using payment methods offered by the vendor, which may include:

• Cash on Delivery; or
• direct electronic payment to the vendor, such as through the vendor's own GCash account.

Any GCash or other direct-payment account displayed by a vendor is controlled by that individual vendor and is not a PH Mechanic account.

Where the Platform permits buyers to submit a payment reference number, amount, or transaction screenshot, this information is provided so the vendor can verify the payment.

PH Mechanic does not guarantee that a buyer's submitted payment proof is genuine or that a vendor has received funds.

10. Orders

Submitting an order does not necessarily guarantee acceptance or fulfillment.

A vendor may need to confirm:

• stock;
• availability;
• shipping;
• delivery location;
• payment; or
• other order details.

Vendors are responsible for updating order and shipping information made available through PH Mechanic.

11. Bookings and Appointments

Bookings submitted through PH Mechanic should generally be treated as booking requests until confirmed by the vendor.

Submitting a booking request does not guarantee:

• vendor acceptance;
• availability;
• service completion time;
• price; or
• arrival time.

No booking payment or deposit is currently processed by PH Mechanic.

Any service payment arranged between a customer and vendor is a separate transaction between those parties unless expressly stated otherwise.

12. Roadside and Emergency Services

PH Mechanic may help users locate businesses offering towing, roadside assistance, vehicle rescue, or similar services.

PH Mechanic is not an emergency-response agency or dispatch service.

PH Mechanic does not guarantee:

• vendor availability;
• emergency response;
• arrival time;
• rescue time;
• service coverage; or
• successful assistance.

If you or another person is facing immediate danger, injury, fire, crime, or another emergency requiring urgent public assistance, contact the appropriate emergency authorities instead of relying solely on PH Mechanic.

13. Reviews and User Content

Users may be allowed to submit reviews, photos, comments, reports, or other content.

You must ensure your content is truthful and based on genuine experience where applicable.

You must not post:

• fake reviews;
• threats;
• harassment;
• unlawful content;
• hate speech;
• sexually explicit material;
• spam;
• intentionally misleading information;
• malicious impersonation;
• content infringing third-party intellectual property; or
• content intended primarily to manipulate ratings.

PH Mechanic may moderate, restrict, hide, or delete content that violates these Terms or applicable law.

Vendors must not manipulate reviews or improperly pressure customers to remove legitimate negative feedback.

14. License to User Content

You retain ownership of content you lawfully own.

When you upload content to PH Mechanic, you grant PH Mechanic a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, distribute, and use that content as reasonably necessary to operate, promote, improve, and display the Platform and relevant listings.

You represent that you own the content or have permission to use it.

15. Prohibited Conduct

You may not use PH Mechanic to:

• violate Philippine law;
• commit fraud;
• sell stolen goods;
• sell counterfeit products;
• sell illegal goods;
• offer unlawful services;
• upload malicious software;
• obtain unauthorized access to accounts or systems;
• scrape or harvest personal information unlawfully;
• impersonate another person;
• manipulate reviews;
• interfere with Platform security;
• distribute intellectual-property-infringing content;
• threaten or harass users;
• falsify payment proof;
• submit fraudulent verification documents; or
• evade account suspension.

16. Restricted and Prohibited Products

Products prohibited by Philippine law may not be listed.

Regulated products may only be offered where the vendor possesses and maintains all required licenses, permits, registrations, and authorizations.

PH Mechanic may immediately restrict or remove products that appear illegal, counterfeit, stolen, unsafe, recalled, dangerous, fraudulent, infringing, or unlawfully regulated.

Philippine marketplace law expressly requires online marketplaces to address regulated goods and provides specific responsibilities concerning prohibited, unsafe, or dangerous products.

17. Platform Enforcement

PH Mechanic may investigate suspected violations.

Depending on the circumstances, PH Mechanic may:

• issue warnings;
• remove content;
• deactivate products;
• restrict marketplace functionality;
• suspend accounts;
• revoke listing privileges;
• revoke verification;
• terminate accounts;
• preserve relevant records;
• cooperate with authorities; or
• take other reasonable action.

18. Intellectual Property

PH Mechanic's name, website design, original software, platform content, graphics, branding, databases, and other proprietary materials are owned by or licensed to PH Mechanic or JDWebcraft Web Development Services unless otherwise stated.

You may not reproduce, sell, copy, or commercially exploit PH Mechanic's proprietary materials without permission.

19. Third-Party Services

PH Mechanic may rely on third-party providers for hosting, mapping, authentication, communications, analytics, payment processing for PH Mechanic subscriptions, and other technical services.

PH Mechanic is not responsible for independent third-party websites or services that operate under their own terms and policies.

20. Disclaimer of Warranties

To the extent permitted by law, PH Mechanic is provided on an "as available" basis.

We do not guarantee uninterrupted operation, error-free operation, or that every vendor listing, product listing, review, map result, availability status, price, delivery estimate, or other third-party information will always be accurate.

Nothing in this section limits rights or warranties that cannot legally be excluded.

21. Limitation of Liability

To the extent permitted by applicable law, PH Mechanic is not responsible for indirect or consequential losses resulting solely from the independent acts or omissions of third-party vendors or users.

However, these Terms do not exclude PH Mechanic's liability where liability cannot lawfully be excluded, including responsibilities that may arise under applicable Philippine consumer or e-commerce law.

The Internet Transactions Act provides circumstances where an online merchant is primarily responsible for a transaction and where an e-marketplace may have subsidiary or solidary responsibility.

22. Suspension and Termination

PH Mechanic may suspend or terminate access where reasonably necessary due to:

• serious policy violations;
• fraud;
• false verification;
• illegal conduct;
• repeated complaints;
• security risks;
• intellectual property violations;
• harmful conduct; or
• legal requirements.

23. Changes to PH Mechanic

We may modify, add, remove, or discontinue Platform functionality.

Material changes affecting contractual or privacy rights will be communicated where required.

24. Governing Law

These Terms are governed by the laws of the Republic of the Philippines.

Subject to applicable consumer rights, mandatory jurisdiction rules, and available administrative remedies, disputes that require judicial proceedings shall be submitted to the appropriate Philippine courts, including courts with proper jurisdiction in Davao City where legally appropriate.
